1. Acceptance of Terms
Welcome to Levelium. By accessing or using the Levelium mobile application, website (levelium.app), or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you must not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
You must be at least 16 years old to use Levelium. By using the Service, you represent and warrant that you meet this age requirement.
2. User Accounts
To access certain features of Levelium, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security and confidentiality of your login credentials.
- Not share, transfer, or sell your account to any other person.
- Notify us immediately of any unauthorized use of your account at legal@levelium.app.
You are solely responsible for all activity that occurs under your account. Levelium is not liable for any loss arising from unauthorized use of your account.
3. Description of the Service
Levelium is a gamified productivity application that transforms real-life tasks into an RPG experience. The Service includes, but is not limited to:
- Creating and completing missions and habits.
- Character progression (experience points, levels, attributes, and ranking).
- Equipment and cosmetic customization.
- AI-powered coaching via "The Architect".
- Battle Pass seasonal content.
- In-app purchases and premium features.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
4. Virtual Currency, Items & In-App Purchases
Levelium offers virtual items and currency ("Gems") that can be acquired through gameplay or purchased with real money.
4.1 License, Not Ownership
All virtual items, Gems, skins, equipment, cosmetics, and any other digital content within Levelium are licensed to you, not sold. You receive a limited, non-transferable, non-exclusive, revocable license to use these items within the Service. Virtual items have no real-world monetary value and cannot be exchanged, sold, or transferred outside of Levelium.
4.2 Refund Policy
All purchases of virtual currency and items are final and non-refundable, except where required by applicable law (e.g., EU consumer protection laws providing a 14-day withdrawal period for digital content, provided you have not begun consuming the content). Refund requests for purchases made through Google Play or the Apple App Store are subject to their respective refund policies.
4.3 Price Changes
We reserve the right to change the pricing of Gems and virtual items at any time. Prices are displayed in your local currency through the respective app store.
5. Pro Subscription
Levelium may offer a premium subscription ("Levelium Pro") that provides access to enhanced features and exclusive content.
- Recurring Billing: Subscriptions are billed on a recurring basis (monthly or annually) through Google Play or the Apple App Store. Your subscription will automatically renew at the end of each billing period unless cancelled.
- How to Cancel: You can cancel your subscription at any time through your device's app store settings (Google Play Store → Subscriptions, or Apple Settings → Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until then.
- No Partial Refunds: We do not provide refunds or credits for partial subscription periods, except where required by applicable law.
- Free Trials: If offered, free trial periods convert to paid subscriptions automatically unless cancelled before the trial expires.
6. Fair Play & Code of Conduct
Levelium is built on the principle of real effort = real progress. The integrity of the ranking and progression system is fundamental to the experience. You agree to the following rules:
6.1 Prohibited Activities
You must not, under any circumstances:
- Use bots, scripts, automated tools, or macros to complete missions, earn XP, or interact with the Service.
- Exploit bugs, glitches, or vulnerabilities to gain unfair advantages in levels, rank, Gems, or items.
- Use hacks, modified clients, or third-party software that alters or interferes with the normal operation of the app.
- Manipulate the streak or ranking system through any artificial means.
- Engage in account boosting, XP farming, or any form of fraudulent activity.
- Harass, abuse, or engage in harmful behavior towards other users.
- Attempt to reverse-engineer, decompile, or disassemble the Service.
6.2 Enforcement
⚠️ Zero Tolerance Policy: Levelium reserves the right to investigate and take action against any user suspected of violating these rules. Actions may include, without prior notice: temporary suspension, permanent account ban, forfeiture of all virtual items and progress, and/or reporting to relevant authorities where illegal activity is involved. Decisions regarding anti-cheat enforcement are final.
7. Intellectual Property
All content, materials, and technology within Levelium — including but not limited to the software, source code, design, artwork, illustrations, icons, animations, audio, character designs, UI/UX elements, text, logos, trademarks, and branding — are the exclusive property of Levelium and its licensors.
These materials are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable license to use the Service for its intended purpose only. You may not:
- Copy, modify, distribute, or create derivative works based on Levelium content.
- Use Levelium branding, logos, or assets without prior written permission.
- Scrape, data-mine, or extract content from the Service for any purpose.
8. User-Generated Content
Any content you create within Levelium (e.g., mission names, character names, chat messages to The Architect) remains yours. However, by submitting content to the Service, you grant Levelium a non-exclusive, royalty-free, worldwide license to use, process, and store such content as necessary to provide and improve the Service.
You represent that you have the right to submit any content you provide and that such content does not infringe on any third party's rights.
9. Termination
We may suspend or terminate your account and access to the Service, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms of Service.
- Engaging in prohibited activities (see Section 6).
- Fraudulent, abusive, or illegal behavior.
- Extended inactivity (accounts inactive for more than 12 months may be subject to deletion after notice).
Upon termination, your license to use the Service is immediately revoked. All virtual items, Gems, progress, and data associated with your account may be permanently deleted. No refunds will be provided for any purchases made prior to termination for cause.
You may also terminate your account at any time by requesting account deletion through the app settings or by contacting us at legal@levelium.app.
10. Disclaimers & Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Levelium does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
To the maximum extent permitted by applicable law, Levelium and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of virtual items or progress.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain.
For EU consumers: You may also be entitled to submit disputes to the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
